I. Introduction

We, Dr. Paul Lohmann GmbH & Co. This mandatory information also applies to Lohmann Performances GmbH.

This mandatory data protection information complies with our obligation to inform as the controller as per Art. 12-14 GDPR.

 

III. Information on data collection and processing

The following provides information on which personal data can be collected about you, who is identified or identifiable as a natural person (called data subject in the following).

This includes for example:

  • Customer master data for contract/service performance, name, address, e-mail address, data related to payment handling, correspondence (e.g. letter or e-mail correspondence with you), advertising and sales data (e.g. information about new potentially interesting offers via mail or e-mail with corresponding consent)
  • Data from contact initiations such as name, telephone number, e-mail address
  • Supplier data such as name, telephone number, e-mail address
  • Employment data such as name, address, bank data, religious affiliation, personnel number, social security number, protocol data that are required for the use of IT systems as well as other and special categories of personal data
  • Applicant data such as name, address, e-mail address, marital status, religious affiliation

 

IV. Right of complaint

If you believe that the processing of your personal data violates the General Data Protection Regulation, you have the right to lodge a complaint with the data protection supervisory authority that has jurisdiction over us in Lower Saxony https://lfd.niedersachsen.de/ as well as any other data protection authority.

 

V.  Purpose of processing

1. Customer data/Interests

Purpose of processing

We process data that we receive within the scope of handling our business relationship with you. We receive the data directly from you. This comes from either inquiries from interested customers and contact requests, or order placement and order processing (see section “Data collection and processing”).

Legal basis

Data collection and data processing is required for the performance of a contract and based on Art. 6 Para. 1 (b) GDPR. The use for direct marketing is based on Art. 6 Para. 1 (f) GDPR. It is in our legitimate interest to make you aware of special offers by means of direct marketing. The data are not shared with third parties unless stipulated by law, e.g. within the scope of tax laws and required to be provided to the relevant tax authority. The data are deleted as soon as they are no longer required for the purpose of data processing and/or after expiration of any statutory storage periods (for example, accounting records relevant to commercial and tax laws: 10 years; commercial and business correspondence: 6 years; records regarding suppliers, type, quantity, purchasing, delivery: 3 years).

You have the right to object at any time to the use of your personal data for the purpose of direct marketing. In addition, you also have the right to request information on your personal data stored by us as well as the right of rectification in the case of incorrect personal data and/or the right of erasure in the case of unlawful personal data storage. You also have the right to lodge a complaint with a regulatory authority (see point “Right of complaint”).

Duration of data storage

The data are deleted as soon as they are no longer required for the purpose of data processing and/or after expiration of any statutory storage periods (for example, accounting records relevant to commercial and tax laws: 10 years; commercial and business correspondence: 6 years; records regarding suppliers, type, quantity, purchasing, delivery: 3 years).

Deletion of data

Your personal data are deleted at the latest after the expiry of the time periods listed above.

 

2. Suppliers

Purpose of processing

We process data that we receive within the scope of handling our business relationship with you. We receive the data directly from you for order placement and order processing (see point “Information on data collection and processing”).

4. Job applications

Purpose of processing

When you apply for an open position with us, we will collect your personal data such as first name, last name, address, telephone number, e-mail address, documentation (cover letters, CV, job references, photo) and store them for the duration of the selection process.

Your personal data will only be used by authorized persons from the HR department and/or management within the scope of the selection process. Your personal data will not be passed on to third parties.

If the specific position that you are applying for should be granted to someone else and you could still be considered for later employment or employment in a partner or subsidiary company due to your profile, then we will request your express permission before further storage or sharing of your application unless you have otherwise already provided your express permission in your application for this type of storage and/or sharing.

If you apply for a position with us on your own initiative using our general contract e-mail address, then the content of your application e-mail can be read by non-authorized personnel. For this situation, the guideline is in place that the application documentation should remain unopened and immediately be forwarded to the HR department and the incoming e-mail deleted. If you would like to exclude this, we ask that you please get in contact with us via telephone before sending your unsolicited application so that we can provide you with the contact information of the appropriate contact person.

The legal basis is Art. 6 Para. 1 (b) GDPR, for processing prior to entering into a contract.

Unless you inform us otherwise, your personal data will be deleted and/or destroyed (in the case of applications via mail) 6 months after the completion of the application process. Due to the long application and selection periods for apprentices, we will save this data in Germany for up to 18 months.

If the relevant legal conditions exist, you have the following rights: The right to information about your personal data stored by us; the right to rectification, deletion, restriction of the processing of your personal data or the right to object to the processing as well as the right to data portability. You naturally also have the option at any time to arrange the deletion and/or destruction of all application documentation by sending an e-mail to karriere@lohmann-chemikalien.de.

 

5. Newsletter

Purpose of processing

If you would like to receive the newsletter offered on the website, then we require your e-mail address. A double opt-in process is used to register for the newsletter. This means that you will receive an e-mail after registering in which you must confirm your registration. This process is used to ensure that no unauthorized person can register using your e-mail address. Logging takes place via your registration for the newsletter (storing the time of registration and confirmation as well as the IP address). Logging is used to verify the registration process in accordance with legal requirements.

You can revoke your consent to the storage of the e-mail address (and optional first name and last name for the purpose of a personal address) as well as the sending of the newsletter with an associated performance measurement. A cancellation link is included at the end of every newsletter. It may be possible that we will store this canceled e-mail address for up to 2 years before deletion so that we can prove that we formerly had permission for this e-mail address.

The legal basis for sending the newsletter and the associated performance measurement:

This is based on the consent of the recipient as per Art. 6 Para. 1 (a) GDPR, Art. 7 GDPR together with § 7 Para. 2 No. 3 UWG (the German Fair Trade Practices Act) and/or based on legal permission as per § 7 Para. 3 UWG.

As well as Art. 6 Para. 1 (f): Our legitimate interest in performance measurement is based on determining the reading habits of our users due to the opening of the newsletter, opening times and the links being accessed so that we can then create and send interest-based and useful contents.                              

The legal basis for logging is Art. 6 Para. 1 (f) GDPR. Our legitimate interest here is that we would like to provide a safe and user-friendly newsletter system that is beneficial for sending and that protects the personal data of newsletter subscribers. In addition, this also enables us to verify consent.

You have the right to request information on your personal data stored by us as well as the right of rectification in the case of incorrect personal data and/or the right of erasure in the case of unlawful personal data storage. You also have the right to lodge a complaint with a regulatory authority (see point “Right of complaint”).

VI. Purpose of processing in third countries

We transfer your personal data to third countries outside of the EU provided that this is required due to your query or required for processing.

This is the case provided that a separate representation or subsidiary company is present in the country from which the query originates. In this case, it is required that the further processing of your concern be performed in the respective country.

You have the option of direct communication in the respective country. Otherwise you agree to the transfer and processing of your data.

 

VII. Categories of recipients

Within the context of delivering our services, we employ service providers committed to confidentiality and to data protection for special areas in which access to personal data cannot be ruled out.

These categories of recipients include:

  • Processors employed by us (Art. 28 GDPR) particularly in the area of IT services, administration, logistics and printing services, who process your personal data for us with a duty to comply with instructions.
  • Public authorities and institutions (tax authorities) in the case of the existence of a legal or regulatory requirement.
  • Other bodies for which you have given us your consent for data transfer.

Data is only passed on to public bodies if higher-ranking legal provisions apply.

 

VIII. Marketing and the right to object

The collection of last name, first name and address also takes place for marketing purposes (the sending of offers, information about additional services). IX. Objection to personal data storage

If the legal requirements are met, you may request deletion or restriction of processing as well as object to processing (Art. 17, 18, and 21 GDPR).

If you wish to have data erased in cases where we are still obliged to keep data on record, access to your data is restricted (blocked). The same applies to cases where you raise an objection. You can exercise your right to data portability to the extent that the recipient and we have the technical capabilities.
